Sheikh Raed Salah Thanks ITN for Leading His Legal Team

ITN’s Tayab Ali represented Sheikh Raed Salah, prominent leader of the largest Palestinian organisation in Israel, in his appeal against the Secretary of State for the Home Department’s exclusion and deportation orders.

The Secretary of State had alleged that Sheikh Raed Salah’s presence in the United Kingdom was not conducive to the public good. She had relied on incorrect information to conclude that Sheikh Salah was anti-Semitic and promoted violence. She then made a personal decision to exclude him in June 2011 in accordance with the Government's Prevent policy.

Following a 10 month legal battle with the Secretary of State which included, a successful Judicial Review of his detention, Senior Immigration Judge Ockleton who is the Vice President of the Upper Tribunal ruled that the deportation order was ‘entirely unnecessary’, and that the Secretary of State had been ‘misled’. He went further to say that he found that the exclusion order issued against Sheikh Raed Salah was ‘unlawful’ as the Secretary of State had relied on the same facts.

Sheikh Salah’s legal team was led by Tayab Ali, Partner at ITN solicitors. Advocacy in the High Court, First Tier Tribunal and the Upper Tribunal was led by the very respected and talented Raza Husain QC of Matrix Chambers. The advocacy team was completed with the addition of the brilliant and dedicated Duran Seddon of Garden Court. At Sheikh Salah’s leaving event he presented Tayab Ali with a gift as a symbol of his ‘deep appreciation’ for the work done on his behalf.   

Sheikh Raed Salah returned to Israel on Monday. On arrival he was briefly detained, issued with an order preventing him attending the Al Aqsa Mosque compound and then finally allowed to return home.
